Applicable to: Job Seekers, Employers, and Institutions
1. Introduction and Acceptance of Terms
Welcome to Apuphi — an AI-Powered Career Ecosystem. In Phase 1, Apuphi connects Job Seekers, Employers, and Institutions through an integrated platform designed to accelerate career growth, enable smart recruitment, and power data-driven placement management.
These Terms and Conditions (“Terms”) govern your access to and use of the Apuphi platform, including its website (www.apuphi.com), mobile application, and all related services (collectively, the “Platform”). By registering, accessing, or using Apuphi, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Platform.
2. Definitions
- "Apuphi" or "Platform"
- refers to the Apuphi web and mobile application and all services, features, and tools offered therein.
- "User"
- means any individual or entity that registers or uses the Platform. In Phase 1, Users are Job Seekers, Employers, or Institutions.
- "Job Seeker"
- means an individual who uses the Platform to search for employment, improve their profile, and manage career development.
- "Employer"
- means a company, organisation, recruiter, or individual who uses the Platform to post job listings, manage candidates, and conduct recruitment activities.
- "Institution"
- means a college, university, or educational organisation that subscribes to the Apuphi Institutional Plan to manage student placement activities and access a digital placement intelligence dashboard.
- "TPO"
- means Training and Placement Officer — the primary institutional administrator for the Platform.
- "Student"
- means a Job Seeker who is enrolled at and linked to a registered Institution on the Platform.
- "Apuphi Score"
- means the AI-generated professional credibility score ranging from 300 to 900 assigned to Job Seekers based on verified skills, experience, and platform activity.
- "Auto-Apply"
- means the AI-driven feature that automatically submits job applications on behalf of a Job Seeker with their explicit prior consent.
- "AI Interview Report"
- means the automated analysis generated by the Platform from an interview audio transcript.
- "Subscription"
- means any paid plan (Free, Premium Monthly, Premium Annual, or Employer tier) granting access to specific Platform features.
- "Content"
- means any text, data, resumes, job postings, videos, profiles, reports, or other material submitted to or available on the Platform.
- "Phase 1"
- means the current operational scope of the Platform, covering the Core Platform & Job Tech module for Job Seekers and Employers only. Mentor, Course Creator, and Task Worker roles are not part of Phase 1.
3. Eligibility and Account Registration
3.1 Eligibility
Apuphi welcomes users of all ages, including students and young professionals. There is no minimum age requirement to register on the Platform. However, if you are under 18 years of age, you must have the consent of a parent or legal guardian before registering and using the Platform. By registering, a user under 18 confirms that their parent or legal guardian has been informed of and has consented to their use of the Platform. You must: (a) not be prohibited from using the Platform under any applicable law; and (b) provide accurate, complete, and current registration information.
3.2 Account Creation
Users may register via Email, Phone number, Google OAuth, or LinkedIn. WhatsApp OTP verification is used for identity confirmation. Each individual may hold only one primary account. Employers may create recruiter sub-accounts under their main company account, subject to their subscription tier.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your credentials. You agree to notify Apuphi immediately at support@apuphi.com if you become aware of any unauthorised access to your account.
3.4 Employer Verification
Employers must submit business verification documents (company registration certificate, trade licence, or equivalent) for admin approval before accessing job posting and ATS features. Apuphi reserves the right to suspend accounts that provide false or misleading verification information.
4. Phase 1 User Roles and Permitted Use
4.1 Job Seekers
Job Seekers may use the Platform to:
- Create and manage professional profiles, resumes, and digital portfolios.
- Discover, apply for, and track job opportunities — including both Platform-posted and aggregated external listings.
- Activate Auto-Apply (with explicit consent) for Top 20 or Top 50 AI-matched positions, with duplicate application prevention.
- Access the in-platform interview scheduling system and video interview interface.
- View their Apuphi Score, profile completion status, and job match percentages on listings.
- Access the Career Goal Segment (Career GPS) and Career Reset feature for guided career planning.
- View AI-generated skill gap analysis and browse external course listings via affiliate links (read-only; no internal course hosting in Phase 1).
- Receive engagement communications via WhatsApp, email, and in-app notifications.
- Download AI-generated interview reports post-interview.
4.2 Employers
Employers may use the Platform to:
- Post, manage, edit, and close job listings within their subscription limits.
- Access the ATS (Applicant Tracking System) dashboard to review, shortlist, reject, or schedule candidates.
- View candidate profiles including Apuphi Score and job match percentage.
- Conduct in-platform video interviews (1:1 or panel format) with recording and transcript access.
- Access AI Interview Reports after completing and submitting their own manual interview assessment.
- Integrate external career pages for automated job syncing.
- Access the verified candidate pool subject to subscription tier.
- Manage recruiter sub-accounts under the main employer account.
4.3 Institutions
Educational institutions (colleges, universities) that subscribe to the Apuphi Institutional Plan may use the Platform to:
- Access a dedicated Institution Dashboard, completely separate from candidate and employer interfaces.
- Onboard students via one of three methods: (a) Bulk CSV Invite; (b) Unique Institution Code; or (c) Domain Restriction.
- Grant admin access to TPOs, Placement Officers, and Deans, with sub-admin roles for Department Placement Coordinators.
- View the Student Overview Panel: total students registered, profile completion percentage, skill score average, job-ready score, course completion metrics, and active job seekers.
- Access the Student Management Panel: view individual student profiles, resumes, skill scores, job applications submitted, interview reports, and employer feedback — subject to the student's explicit consent.
- Track placement activity in real time: applications submitted, shortlisting by company, interview attendance, final selections, and department-wise placement ratios.
- Access Skill Gap Analytics: top skill gaps across final-year students, most in-demand market skills, percentage lacking key certifications, and interview weakness patterns.
- Use the Employer Coordination Module: invite companies for campus hiring drives, share filtered student lists, schedule interview drives, and export shortlists.
- Export NAAC-ready placement reports (Premium Institutional Plan).
4.4 Phase 1 Scope Boundary
Phase 1 covers Job Seekers, Employers, and Institutions only. The Mentor module, Course Creator module, and Task Worker module are not available in Phase 1 and are planned for subsequent phases.
4.5 Prohibited Activities
All Users are strictly prohibited from:
- Submitting false, misleading, or fraudulent information, credentials, or job listings.
- Using the Platform for any unlawful purpose, including discrimination, harassment, or fraud.
- Scraping, copying, reverse-engineering, or replicating any part of the Platform without authorisation.
- Creating multiple fraudulent accounts or impersonating any person or entity.
- Uploading or transmitting viruses, malware, or harmful code.
- Using another candidate's profile, credentials, or identity for job applications.
- Circumventing any subscription restrictions, access controls, or security measures.
- Posting non-existent or fraudulent job listings designed to harvest personal data.
- Using automated bots, crawlers, or scripts not authorised by Apuphi.
5. AI Features and Consent
5.1 Auto-Apply
By activating Auto-Apply, you explicitly consent to Apuphi submitting job applications to matched listings on your behalf. A complete audit trail of all automated applications is maintained. Apuphi prevents duplicate applications to the same employer. Apuphi is not responsible for employer responses or outcomes from automatically submitted applications.
5.2 Agentic Browser Automation
For job applications on third-party sites (LinkedIn, Indeed, and other platforms), Apuphi uses agentic AI browser automation. By enabling this feature, you consent to the Platform navigating those third-party sites on your behalf. Apuphi handles your session credentials securely and maintains a full audit trail. A guided manual fallback is provided where automated application is blocked by CAPTCHA or two-factor authentication.
5.3 AI Interview Reports
The Platform generates AI-powered reports from audio transcripts following interviews conducted on the Platform. These reports include keyword matching, communication clarity assessment, sentiment analysis, and recommendation flags. They are advisory in nature only. An Employer may only access the AI Interview Report after submitting their own manual interview assessment. Apuphi does not guarantee the accuracy of AI-generated analysis.
5.4 Apuphi Score
The Apuphi Score (300–900) is a dynamic, AI-calculated metric reflecting a Job Seeker's professional credibility across five components: Skills Assessment (30%), Project Portfolio (25%), Domain Expertise (20%), Professional History (15%), and Platform Engagement (10%). The Score is indicative and does not constitute a guarantee of employment or employer selection.
5.5 Resume Auto-Tailoring
When a Job Seeker applies for a position, the Platform's AI may automatically tailor the resume to match the job description for ATS compatibility. The Job Seeker may preview and approve the tailored resume before submission. Apuphi retains both the master profile and job-specific tailored versions.
6. Learning Content — Phase 1 Scope
In Phase 1, the Platform provides read-only access to external course listings via affiliate links for skill-gap bridging purposes. No internal course hosting, creation, or certification is offered in Phase 1. Apuphi tracks click-through data on course links for affiliate commission purposes. The Platform does not verify or endorse the quality of any third-party course content.
7. Content and Intellectual Property
7.1 User Content
You retain ownership of content you submit to the Platform (resumes, portfolio links, certifications, etc.). By submitting content, you grant Apuphi a non-exclusive, royalty-free, worldwide licence to use, store, display, and process your content solely for the purpose of operating and improving the Platform.
7.2 Apuphi Intellectual Property
All Platform technology, software, design, branding, algorithms (including the Apuphi Score engine and AI interview analysis system), and Apuphi-created content are the exclusive intellectual property of Apuphi and its licensors. Users may not reproduce, distribute, or create derivative works from any Apuphi-owned content or technology without prior written authorisation.
7.3 AI Interview Reports
AI Interview Reports are accessible to both the Job Seeker and the Employer who conducted the interview, subject to the interviewer workflow requirement (the employer must submit their manual assessment first). Reports may not be shared with third parties without consent from both parties.
8. Subscriptions, Payments, and Refunds
8.1 Job Seeker Plans
Apuphi offers a freemium model for Job Seekers. The Free plan provides access to core job search features. Paid subscription plans unlock additional capabilities including Auto-Apply, priority matching, Career GPS, Career Reset, WhatsApp job alerts, and the CV builder. 8.2 Employer Plans
Apuphi offers tiered subscription plans for Employers with varying levels of job posting limits, ATS access, candidate pool access, video interview features, and AI interview report capabilities. Current plan details and pricing are available at the Plans page within the Platform.
8.3 Billing and Renewals
Subscriptions are billed in advance. Annual plans are billed in full at the start of the subscription period. Monthly plans auto-renew unless cancelled at least 48 hours before the next billing date.
8.4 Refund Policy
Subscription fees are non-refundable except where required by applicable Indian law. One-time purchases (credit top-up packs) are non-refundable once the credits have been added to your account. Apuphi may, at its sole discretion, offer a prorated credit in cases of documented platform failure materially affecting service delivery. Raise payment disputes at support@apuphi.com.
9. Institutional Accounts and Obligations
9.1 Institutional Access and Onboarding
Educational institutions that subscribe to the Apuphi Institutional Plan purchase access on a per-semester basis. Institutions receive a dedicated dashboard, completely segregated from candidate and employer interfaces, with access to features including student onboarding, placement KPI tracking, skill gap analytics, and employer coordination — varying by plan tier. Current institutional plan details and pricing are available at the Plans page within the Platform.
9.2 Institutional Responsibilities
By subscribing to an Institutional Plan, the institution agrees to:
- Ensure that all students are informed of, and have consented to, the sharing of their personal data with the institution before any such data is accessed on the dashboard.
- Use student data accessed through the Platform solely for internal placement, career development, and accreditation reporting purposes.
- Appoint a designated administrator (TPO, Placement Officer, or Dean) as the primary account holder, responsible for compliance with these Terms.
- Ensure sub-admin accounts (Department Coordinators) are used only by authorised institutional staff.
- Not share, export, or transfer student data to any third party without the student's separate explicit consent.
- Maintain the confidentiality of their institution code and dashboard credentials.
9.3 Student Consent Requirement
Institutions may only access individual student profile data, application history, interview reports, and employer feedback where the student has provided explicit prior consent to such institutional access. This consent is separate from the student's general Platform usage consent and may be withdrawn by the student at any time. Withdrawal of consent will restrict the institution's visibility of that student's data without affecting the student's own Platform access.
9.4 Employer Coordination
Through the Employer Coordination Module, institutions may invite companies to conduct campus hiring drives, share filtered student lists with prospective employers, and schedule on-campus interview drives. Any employer invited through this module is subject to Apuphi's standard employer verification requirements. Institutions remain responsible for ensuring they share only consented student data with invited employers.
10. Termination and Suspension
Apuphi may suspend or terminate any account at its sole discretion, with or without prior notice, in cases including: breach of these Terms; submission of fraudulent information; non-payment of subscription fees; or conduct harmful to other Users or the Platform. Upon termination, your access ceases immediately. Data deletion requests may be submitted per Section 22 of the Privacy Policy.
11. Disclaimers and Limitation of Liability
11.1 Apuphi is a Job Aggregator, Not a Recruitment Agency
Apuphi is a technology platform and job aggregator that connects Job Seekers with Employers. Apuphi is not a recruitment agency, staffing firm, headhunter, or employment service. Apuphi does not act as an agent or representative of any Employer or Job Seeker. Apuphi does not screen, endorse, select, or place candidates in roles, and does not guarantee that any Job Seeker will receive an interview, offer of employment, or placement of any kind. Similarly, Apuphi does not guarantee that any Employer will find a suitable candidate through the Platform. Any hiring decision is made solely and entirely between the Employer and the Job Seeker, without any involvement, responsibility, or liability on the part of Apuphi.
11.2 No Guarantee of Employment or Candidate Placement
Apuphi makes no representation, warranty, or guarantee — express or implied — that use of the Platform will result in employment, job offers, successful recruitment, or any specific professional outcome. The Apuphi Score, job match percentages, AI Interview Reports, Career GPS recommendations, and all other AI-generated outputs are provided for guidance purposes only. They do not constitute a promise, prediction, or commitment of any professional result. Apuphi shall bear no liability for a Job Seeker's failure to secure employment or an Employer's failure to find candidates through the Platform.
11.3 AI-Generated Content is Guidance Only — Not Authoritative
Apuphi is an AI-powered guidance system. All AI-generated outputs on the Platform — including but not limited to the Apuphi Score, job match scores, resume tailoring suggestions, career path recommendations, skill gap analysis, interview performance reports, Career GPS guidance, Career Reset suggestions, and risk flags for automation-threatened roles — are suggestions and guidance only.
AI systems can make errors, produce inaccurate outputs, or generate suggestions that are not suitable for every individual's circumstances. Apuphi's AI outputs must not be treated as definitive professional advice, guaranteed predictions, or binding recommendations. Users should exercise their own independent judgement when acting on any AI-generated suggestion from the Platform.
No legal action, claim, or dispute may be brought against Apuphi on the basis of any AI-generated suggestion, prediction, recommendation, score, report, or guidance provided through the Platform, whether or not the User relied upon it.
11.4 No Liability for Fake, Fraudulent, or Misleading Listings
While Apuphi endeavours to maintain the integrity of the Platform through employer verification, automated fraud detection, and moderation processes, Apuphi cannot guarantee the authenticity, accuracy, or legitimacy of every job listing, employer profile, candidate profile, or institutional profile on the Platform.
Apuphi shall not be liable for any loss, harm, or damage arising from: (a) fraudulent or non-existent job listings posted by third parties; (b) false, exaggerated, or misleading employer profiles or company representations; (c) false or inflated candidate profiles, credentials, or qualifications; or (d) misrepresentation by any educational institution regarding its accreditation, legitimacy, or placement track record.
Users are encouraged to independently verify the identity and legitimacy of any Employer, Job Seeker, or Institution they interact with through the Platform before making any professional or financial commitment. If you suspect a fraudulent listing, profile, or institution, please report it immediately to support@apuphi.com.
11.5 No Involvement in User Disputes
Apuphi is a neutral technology platform. Apuphi does not mediate, arbitrate, or intervene in any dispute, disagreement, or conflict arising between Users, including but not limited to: disputes between a Job Seeker and an Employer regarding hiring decisions, rejection, compensation, interview conduct, or offer withdrawal; disputes between an Institution and an Employer regarding campus hiring commitments, candidate quality, or placement outcomes; disputes between a Student and an Institution regarding data sharing, placement support, or dashboard access; and disputes arising from transactions, contracts, or agreements entered into between Users outside of the Platform.
Apuphi provides the technology infrastructure to facilitate connections and does not assume any responsibility for the actions, omissions, representations, or conduct of any User. All disputes between Users must be resolved directly between the parties involved. Apuphi shall not be joined as a party to any such dispute, and no User may bring a claim against Apuphi arising from another User's conduct.
11.6 No Legal Liability for Platform-Facilitated Outcomes
To the fullest extent permitted by applicable law, Apuphi shall not be liable for any legal claim, suit, action, or proceeding arising from or relating to: AI-generated scores, reports, suggestions, or recommendations; job matching outcomes or the absence of matches; hiring decisions made by Employers or rejections experienced by Job Seekers; fraudulent job listings, fake employer profiles, or misrepresented candidate credentials; placement outcomes or the lack thereof for students linked to Institutions; Auto-Apply submissions and their results; AI interview report content and any consequences of its use in hiring decisions; or disputes between any two or more Users of the Platform.
Apuphi's role is limited to providing a technology platform. Apuphi is not an employment guarantor, a verification authority, a legal arbitrator, or a party to any agreement between Users.
11.7 Platform Availability
Apuphi endeavours to maintain platform uptime but does not warrant uninterrupted or error-free service. Scheduled maintenance or technical issues may result in temporary unavailability.
11.8 Limitation of Liability
To the maximum extent permitted by applicable law, Apuphi's total aggregate liability to any User for any claim, whether in contract, tort, statute, or otherwise, shall not exceed the total amount paid by that User to Apuphi in the three months immediately preceding the event giving rise to the claim. Apuphi shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of employment opportunity, loss of revenue, loss of data, or reputational harm, regardless of whether Apuphi has been advised of the possibility of such damages.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019. Apuphi is registered and headquartered in Siliguri, West Bengal, India.
In the event of any dispute arising out of or in connection with these Terms or the Platform, the parties shall first attempt to resolve the matter through good-faith negotiation by writing to support@apuphi.com. If the dispute remains unresolved within 30 days of written notice, it shall be subject to the exclusive jurisdiction of the competent courts in Soreng, Sikkim, India. Apuphi may also offer arbitration as an alternative dispute resolution mechanism under the Arbitration and Conciliation Act, 1996.
For the avoidance of doubt, Apuphi shall not be a party to, or be required to participate in, any dispute between Users (Job Seekers, Employers, Institutions, or Students). Such disputes are solely between the Users concerned and must be resolved independently of the Platform.
13. Changes to Terms
Apuphi reserves the right to modify these Terms at any time. Users will be notified of material changes via registered email and in-app notification. Continued use of the Platform after the effective date of revised Terms constitutes acceptance.
